Disclaimer 1 — Patch Test and Pre-Use Advisory

This is the single most important step before using any Zuame product for the first time. Please do not skip it.

1. Patch Test — Mandatory Before First Use

Before applying any Zuame product to your face, body, scalp, or hair for the first time, perform a patch test: apply a small amount of the product to the inner forearm, leave undisturbed for 24 hours, and observe for any reaction including redness, itching, swelling, warmth, or irritation.

If any reaction occurs, discontinue use immediately, wash the area with clean water, and consult a dermatologist or physician before proceeding.

Zuame Wellness Private Limited shall not be liable for any adverse reactions arising from failure to conduct a patch test prior to first use, or from continued use following an observed adverse reaction during the patch test period.

We say this clearly because we mean it — not as legal boilerplate. Our formulations contain active botanicals. Most women tolerate them without any reaction. A small number may have sensitivities that only a patch test can reveal. The two minutes this takes are yours to keep.

Zuame Wellness Private Limited shall not be liable for any adverse reactions, interactions, aggravation of existing conditions, or absence of expected results arising from use of our products by a customer with an existing medical condition or in conjunction with ongoing prescribed treatment — whether or not that condition or treatment was disclosed at the time of purchase, whether it was present at the time of purchase, whether it began after purchase and during use, or whether it was diagnosed subsequently.

If an adverse reaction occurs that you believe may be connected to an existing condition or treatment, discontinue use immediately and consult your healthcare provider.

No outcome claim made in Zuame product communications, advertising, social media, or WhatsApp correspondence constitutes a medical warranty or a contractual guarantee of specific results, except as specifically and explicitly stated in our 60-Day Ritual Guarantee (Swarna Radiance Collection) and our Hair First Signs Money Back Guarantee (Hair Restoration Ritual Collection). The full terms of those guarantee documents govern exclusively and supersede any general marketing language.

Disclaimer 4 — Limitation of Liability

4. Limitation of Liability to Purchase Price

To the fullest extent permitted by applicable Indian law, the total liability of Zuame Wellness Private Limited in connection with any product purchased from www.zuamewellness.com — whether arising in contract, tort, product liability, consumer protection law, or otherwise — shall not exceed the purchase price actually paid by the customer for the specific product giving rise to the claim.

Zuame Wellness Private Limited shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of income, loss of opportunity, loss of business, loss of anticipated savings, emotional distress beyond what is directly connected to the product experience, or any claim for damages in excess of the product's actual purchase price.

Nothing in this disclaimer limits or excludes any liability that cannot be excluded under the Consumer Protection Act, 2019 or other applicable Indian law — including liability for death or personal injury caused by our negligence, or liability for fraud or fraudulent misrepresentation.

In plain terms: if something goes wrong with a product you paid ₹1,397 for, our liability is ₹1,397. We will refund it. We will not be liable for claims that exceed what you paid.

Disclaimer 5 — Cosmetic Product, Not Medicine

This distinction has legal significance under Indian law and we state it clearly.

5. Regulatory Status — Cosmetic Formulations

All Zuame products are cosmetic formulations regulated under the Drugs and Cosmetics Act, 1940 and the Cosmetics Rules, 2020. They are not drugs, medicines, therapeutic products, or medical devices. They have not been approved, tested, or registered as drugs by the Central Drugs Standard Control Organisation (CDSCO) or any other regulatory body.

No claim made by Zuame Wellness — in any communication, advertisement, or product material — should be construed as a medical claim, a therapeutic claim, or advice to replace, supplement, modify, or discontinue any prescribed medical treatment.

If you are pregnant, breastfeeding, or planning to become pregnant, please consult your physician before using any Zuame product. Certain botanical ingredients, while safe for general use, may require specific guidance during pregnancy or lactation.

Disclaimer 6 — Proper Use and Misuse

Our products are formulated with care and tested for safe cosmetic use as directed. Their safety and performance depend on being used correctly.

6. Liability Excluded for Misuse and Improper Application

Zuame products must be used strictly in accordance with the directions provided on the product packaging and published on www.zuamewellness.com. Application to broken, damaged, inflamed, infected, sunburned, or otherwise compromised skin or scalp is not advised and is entirely at the user's risk.

Mixing Zuame products with other cosmetic, chemical, medicated, or prescribed preparations not specifically recommended by us may alter their composition, stability, or performance. Zuame Wellness Private Limited shall not be liable for any adverse outcomes resulting from such combination or from any use that deviates materially from the directions provided.

Under Section 87 of the Consumer Protection Act, 2019, a product liability action cannot be brought against a product seller where the harm occurred as a result of misuse, alteration, or modification of the product by the consumer. This disclaimer reflects and reinforces that statutory provision.

Disclaimer 7 — Governing Law and Exclusive Jurisdiction

We are a Bengaluru-based company. In the event that any dispute cannot be resolved directly with us — which we will always attempt first — the following governs where and how that dispute is adjudicated.

7. Governing Law and Jurisdiction — Bengaluru, Karnataka

These terms, and any dispute, claim, or matter arising out of or in connection with any purchase from Zuame Wellness Private Limited — including but not limited to any claim relating to a refund, guarantee, product liability, adverse reaction, or consumer rights — shall be governed exclusively by the laws of the Republic of India.

Subject to the mandatory jurisdiction provisions of the Consumer Protection Act, 2019 (which preserve a consumer's right to approach the appropriate Consumer Disputes Redressal Commission), the parties agree that the courts of Bengaluru, Karnataka shall have exclusive jurisdiction to adjudicate any civil dispute arising from a transaction with Zuame Wellness Private Limited. The parties expressly exclude the jurisdiction of all other courts to the extent permitted by law.

By completing a purchase on www.zuamewellness.com, the customer expressly acknowledges and accepts this jurisdiction clause. The words “exclusive jurisdiction” in this clause are intended to be given full legal effect in accordance with the principles established by the Supreme Court of India in Hakam Singh v. Gammon (India) Ltd. and subsequent authorities.

Your Statutory Consumer Rights Are Not Affected

Nothing in these terms limits, excludes, or overrides any right you hold as a consumer under the Consumer Protection Act, 2019 or any other applicable Indian law. These disclaimers operate within the law — they do not attempt to contract out of it.

If you believe your statutory consumer rights have been violated, you are entitled to approach the appropriate Consumer Disputes Redressal Commission regardless of the jurisdiction clause in Disclaimer 7. That right is expressly preserved.

Our goal is never to avoid legitimate accountability. It is to ensure that any dispute is resolved efficiently, in the right forum, and without unnecessary cost to either party.

Zuame Wellness Private Limited reserves the right to update these terms and disclaimers at any time. The version published on www.zuamewellness.com at the time of purchase governs that transaction. We recommend reviewing this document before each purchase if you have not done so recently.

Material changes will be communicated via our website. Continued use of our website or purchase of our products following any update constitutes acceptance of the revised terms.
